On September 17, 2012, the medical malpractice case of Householter v. Doctor Does 1-3 and their medical group commenced jury trial in the Humboldt Superior Court, Judge John T. Feeney presiding. The plaintiff was represented by James Zito, Esq. and the defendants were represented by the Eureka, California law firm Janssen Malloy LLP.
The physicians, one each practicing in the Emergency Department, Urgent Care Clinic, and Occupational Medicine Department, were alleged to have improperly diagnosed and treated Mr. Householter's work related leg injury, which plaintiff claimed resulted in permanent ambulation and weight bearing limitations and loss of earnings. Expert witnesses were called and testified for both sides: for plaintiff Dr. Douglas Malcolm(Emergency Medicine and Urgent Care Medicine) and Dr. Lawrence Badgley (Occupational Medicine) and for defendants Dr. Michael MacQuarrie (Emergency Medicine), Dr. Stephan Schunk (Urgent Care Medicine), and Dr. Michael Cohen (Occupational Medicine).
The cause was submitted to the jury on September 27. A verdict in favor of each defendant was rendered on September 28, 2012.
